Terms of Service
1. Scope and acceptance
These Terms of Service govern access to and use of masteryourpresencenow.com and the content, communications, digital products and services made available through it, including free content, newsletters, downloadable resources, ebooks, courses, educational materials and any other products or services we offer now or in the future. When you use the website, these Terms set out the rules that apply to that use. When you buy a product, the terms that apply to your purchase are presented to you before you complete the order, and you accept them as part of placing it. Product-specific terms may supplement these Terms where they are clearly disclosed before purchase.
2. Master Your Presence and Shayan SFE B.V.
Master Your Presence is a brand operated by Shayan SFE B.V., a private limited company registered in the Netherlands. Shayan SFE B.V. is the creator, publisher and supplier of Master Your Presence content and products and, where applicable, their licensor. In these Terms, “we”, “us” and “our” refer to Shayan SFE B.V., and “you” refers to the person using the website or buying a product.
3. Lemon Squeezy
Purchases may be processed through Lemon Squeezy, which acts as the merchant of record and authorised reseller for the transaction. When you buy through Lemon Squeezy, you purchase through Lemon Squeezy for payment processing, applicable taxes, receipts, fraud management, chargebacks and related transaction functions, and Lemon Squeezy’s applicable Buyer Terms and Privacy Policy also apply to the parts of the transaction it controls. Shayan SFE B.V. remains responsible for the Master Your Presence product itself, including its content, licence, product support and the other obligations that belong to the supplier. Using Lemon Squeezy does not remove any mandatory consumer rights you have.
4. Products and services
Master Your Presence may offer digital products including ebooks, guides, courses, educational materials, downloads and other digital content. Unless expressly stated otherwise, digital products are supplied electronically and no physical item is shipped. The description, included materials, price, format, compatibility information, access conditions and any product-specific restrictions shown on the applicable sales page form part of your purchase information.
5. Price and payment
Prices and the final amount payable are displayed before you complete an order, and no undisclosed mandatory charges are added after checkout. Where Lemon Squeezy processes the transaction, it calculates and handles any applicable VAT, sales tax or similar transaction taxes in its role as merchant of record. The payment methods available at checkout may vary by location and payment provider.
6. Digital delivery
Digital products are normally delivered electronically after successful payment, through a download page, email, account access or another method described before purchase. If delivery or access fails, contact support@masteryourpresencenow.com and we will help you get access. A technical delivery failure does not remove any rights or remedies you have under applicable law.
7. Right of withdrawal for digital content
If you are a consumer in the European Union or the European Economic Area, you normally have a statutory right to withdraw from a distance contract within 14 days. For digital content supplied immediately and not on a physical medium, this right may end once supply begins, but only where the legal conditions are met: you gave your prior express consent to immediate performance, you acknowledged that you would lose the right of withdrawal once performance begins, and you were given confirmation of the contract on a durable medium. Purchasing a product, clicking a download link or accepting these Terms does not by itself waive your statutory right, and this right exists alongside any voluntary refund guarantee we offer.
8. Withdrawal function
You can exercise a statutory right of withdrawal by sending a clear statement of your decision to refunds@masteryourpresencenow.com, but email is not necessarily the only method available to you. Where applicable law requires an online withdrawal or contract termination function, you remain able to use that function, and any other withdrawal methods required by applicable law remain available where they apply.
9. Statutory consumer rights
Nothing in these Terms restricts your mandatory rights as a consumer. Digital products must meet the legal conformity requirements that apply to them, including materially corresponding to their description and functioning as you may reasonably expect based on the information supplied before purchase. Where content is defective or does not conform, applicable law may provide remedies such as correction, replacement, bringing the content into conformity, a price reduction, termination of the contract or reimbursement. These statutory remedies are separate from any voluntary refund policy.
10. Voluntary refund policy
Where Master Your Presence offers a voluntary refund guarantee, its conditions are explained in the separate Refund Policy. The voluntary policy is in addition to your statutory rights and does not replace or reduce them. Refund questions can be sent to refunds@masteryourpresencenow.com.
11. Intellectual property
Unless otherwise indicated, website content, ebooks, guides, videos, graphics, downloads, course materials, branding, written material and other original Master Your Presence content are protected by applicable intellectual property law. Ownership remains with Shayan SFE B.V., the author or another identified rights holder, as applicable.
12. Personal use licence
When you purchase or download a digital product, you receive a limited, non-exclusive, non-transferable licence to use it for personal purposes, unless the applicable product page expressly grants broader rights. You may download and use the materials on devices you own or control and make reasonable personal backup or print copies where technically possible. You may not resell or distribute the materials, upload them publicly, share complete files with third parties, reproduce them commercially, remove ownership notices or present the work as your own. Nothing in this licence restricts quotation, review, criticism, parody or any other use that the law permits.
13. Accounts and access
If the website offers customer accounts, courses or restricted areas, you are responsible for keeping your login credentials secure and must not intentionally give access to paid content to people who are not authorised to use it. You are not held responsible for security incidents that are outside your reasonable control.
14. Acceptable use
You must not use the website unlawfully, attempt to interfere with its security, gain unauthorised access to any part of it, introduce malicious code, use automated tools in a way that materially disrupts the service, infringe intellectual property or use the website to violate the rights of others. This does not restrict normal browsing, research, quotation or legitimate criticism.
15. Educational purpose
Master Your Presence provides general educational and informational content about communication, presence, charisma, social skills, body language, composure, self-development, human behaviour and related subjects. Unless expressly stated otherwise by a properly qualified professional acting in that capacity, this content is not individualised medical advice, mental health treatment, psychotherapy, legal advice, financial advice or any other regulated professional service. No specific personal, professional, financial, social or relationship outcome is guaranteed.
16. User responsibility
You remain responsible for how you interpret and apply educational information and should use reasonable judgment when doing so. This does not limit our responsibility for our own unlawful conduct, misleading statements, defective products or any other liability that cannot legally be excluded.
17. Testimonials and examples
Where testimonials, case studies, examples, hypothetical scenarios or illustrative situations appear on the website, they are shared for illustration. Individual experiences vary, and examples do not guarantee identical results.
18. Third-party services and links
The website may link to or integrate services operated by third parties, such as Lemon Squeezy, Kit and YouTube. Those services may have their own terms and privacy policies. We are not responsible for the independent operation of third-party services, except where that responsibility cannot legally be excluded.
19. YouTube and social media
Master Your Presence content may also be distributed through YouTube or other platforms, and your use of those platforms is additionally governed by their own terms. Viewing Master Your Presence content on another platform does not transfer ownership of Master Your Presence intellectual property.
20. Newsletter
You may voluntarily subscribe to Master Your Presence emails. Where consent to marketing is required, it is obtained separately and is never hidden inside acceptance of these Terms. You can unsubscribe from marketing emails at any time using the unsubscribe link provided in those emails. Privacy matters are governed by our Privacy Policy.
21. Availability and changes to the website
We may update, improve, replace, discontinue or temporarily interrupt website features or free content. This does not allow us to remove digital content you have already purchased contrary to our contractual or statutory obligations, and your rights relating to purchased products remain subject to the agreement made at purchase and applicable consumer law.
22. Product updates
A purchase does not include unlimited future editions, new volumes or completely redesigned products. If we voluntarily make corrections or revised versions of a purchased product available to existing customers, we may provide them without additional charge, while separate volumes, courses, editions or substantially new products may be sold separately. Nothing in this section limits updates or corrections that applicable digital content law requires.
23. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful or would restrict your mandatory consumer rights, and nothing excludes liability for fraud, deliberate misconduct or any other liability that cannot legally be excluded. To the maximum extent permitted by law, we are not responsible for losses caused solely by misuse of educational content, events genuinely outside our reasonable control or losses that were not a reasonably foreseeable consequence of a breach.
24. Force majeure
We are not responsible for delays or failures caused by events outside our reasonable control, such as major infrastructure failures, hosting outages, natural disasters, government action or widespread service disruptions. This does not remove any refund, termination or other rights that mandatory consumer law grants you.
25. Complaints
You can send complaints about a product, the website or our services to support@masteryourpresencenow.com. We will make reasonable efforts to respond to and resolve legitimate complaints promptly.
26. Governing law
These Terms are governed by Dutch law. If you are a consumer, this choice does not deprive you of the mandatory consumer protections provided by the law of your country of habitual residence where those protections apply, and you are not required to bring proceedings exclusively in the Netherlands where applicable law gives you another competent forum.
27. Changes to these Terms
We may update these Terms for the future when the website, our services or applicable laws change; the date at the top of this page shows the latest version. The terms governing a completed purchase remain those that applied to that transaction, unless a lawful change is required or you expressly agree otherwise.
28. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue to apply to the extent legally possible.
