Privacy Policy
1. Who controls your data
Master Your Presence is operated by Shayan SFE B.V., registered with the Dutch Chamber of Commerce (KvK) under number 93060688, VAT number NL866262234B01, with its address at Bliksemschicht 6, 6846 DG Arnhem, The Netherlands. Where Shayan SFE B.V. decides why and how personal data is processed in connection with Master Your Presence, it is the “controller” of that data, which means it is responsible for it under the EU General Data Protection Regulation (GDPR). Some outside companies handle personal data for us only on our instructions (“processors”), others decide for themselves how they use it for their own purposes (“independent controllers”), and some do both, depending on the task. Where a company such as Lemon Squeezy processes data independently for its own legal purposes, that company, not Shayan SFE B.V., is responsible for that processing. In this policy, “we”, “us” and “our” mean Shayan SFE B.V.
2. What information we collect
We collect only information that is actually processed through the website and the services connected to it. Depending on how you deal with us, this can include your email address and, if you choose to give it, your first name; your newsletter subscription status, how and when you signed up, and records of your consent and confirmation; purchase information that the merchant of record makes available to us, such as the product, the amount paid, the order number, the date and your country or billing location; the messages you send us through the contact form or by email, for example for support, a business enquiry or a refund request; technical information such as your IP address and browser and device details contained in technical and security logs; and information about whether you open our emails and click their links, as explained in section 9. We never receive or store your full card details, because payments are handled by the merchant of record and its payment providers.
3. How we use information
We use personal data to operate and secure the website, deliver the free resources you request, supply the digital products you buy, answer your messages and business enquiries, handle support questions and refund requests, communicate with you about your purchases, keep the accounting records the law requires, run the newsletter, improve our products and emails using lawfully collected information such as which emails are opened and which links are clicked, prevent fraud and abuse of our forms, downloads and purchase notifications, and establish, exercise or defend legal claims. We do not use personal data for purposes this policy does not describe.
4. Legal bases
The GDPR allows us to use personal data only when one of its legal bases applies, and we rely on the following. Contract: we need the data to supply the products you buy and the support that goes with them, or to take steps you ask for before a purchase, such as answering a question about a product. Legal obligation: the law requires us to keep accounting, tax and other records. Consent: you agree to receive the newsletter when you join it, including the measurement of opens and clicks explained in section 9, and you can withdraw that consent at any time. Legitimate interests, meaning interests of ours that your rights do not override: we rely on these only where genuinely appropriate, namely to answer the questions and business enquiries you send us, to keep the website and our forms secure, to prevent fraud and abuse, to establish, exercise or defend legal claims, and, when a newsletter subscriber buys one of our products, to mark them as a customer in Kit so that our emails do not offer them what they already own, as explained in section 10. You can object to processing based on legitimate interests, as explained in section 20.
5. Newsletter
You can choose to subscribe to Master Your Presence emails, which bring you practical lessons on presence and communication together with news about Master Your Presence and its products. Subscribing is voluntary, and your consent must be freely given, specific, informed and demonstrable: the signup form tells you what you are joining, nothing is pre-ticked, and your consent is never hidden in our Terms of Service or bundled with consent to unrelated things. When you sign up through the newsletter form on our website, Kit emails you a link to confirm your subscription and keeps a record of your signup and confirmation. You can withdraw your consent and unsubscribe at any time using the unsubscribe link in every marketing email. Withdrawing consent does not make processing that took place before you withdrew it unlawful.
6. Free resources
When we offer a guide, chapter, checklist, ebook preview or other resource in exchange for joining the newsletter, the form says so plainly: you join the newsletter and receive the resource as a welcome gift. The resource is delivered on screen and through a personal download link sent by email, which expires after seven days, and our website keeps a record of the request and of each download, as described in section 12. If we offer a resource that can be requested without joining the newsletter, we will use your email address only to deliver that resource, unless another lawful basis applies and we tell you about it.
7. Customers and marketing
Buying a product does not add you to our newsletter, and we do not send customers marketing emails they have not asked for. After a purchase you can choose to join at any time with one of the signup forms on our website, including the one on our thank-you page for customers. Every signup form says what you are joining and links to this policy. If you join on the thank-you page, Kit also marks you as a customer, so that our emails do not offer you the product you just bought. You will still receive emails about the purchase itself, such as your receipt from Lemon Squeezy or our answer to a support or refund request. If you already subscribe to the newsletter when you buy, nothing changes: you stay subscribed, and every email contains a one-click unsubscribe link. 8. Email marketing provider
We currently use Kit (formerly ConvertKit) to manage newsletter subscriptions and send our emails. Kit processes subscriber data on our behalf, according to the services enabled in our account and its own contractual and privacy obligations. We use it for our signup forms and email confirmation, to store your email address, optional first name, subscription status and the tags that show how you joined, to hold the code behind your personal download link for free resources, to send our emails and to handle unsubscribes. Kit may also record the web page you signed up from, and it builds an approximate location from your signups, opens and clicks. We have not switched on Kit’s optional link features that add a subscriber ID, analytics codes or a scrambled (hashed) version of your email address to the links in our emails.
9. Email open and click tracking
Kit measures engagement with the emails it sends for us, and it has no setting that lets us switch this off. It records when an email is opened by loading a tiny invisible image (a tracking pixel), and it records clicks by routing the links in our emails through Kit’s own web addresses; both are linked to your subscriber profile. We use this to see which emails and topics are useful. Every signup form links to this policy, which explains this measurement, and by subscribing you agree to it as part of joining the newsletter. You can prevent open tracking by blocking images in your email app, avoid click tracking by not clicking the links, or stop both at any time by unsubscribing.
10. Purchases and Lemon Squeezy
Where a purchase is processed through Lemon Squeezy, which is currently how our products are sold, Lemon Squeezy acts as merchant of record and authorised reseller for the transaction. It processes the information needed to complete and administer the purchase, which can include payment information, billing information, tax information, fraud-prevention information and transaction records, and it is independently responsible for that processing under its own Privacy Policy. Lemon Squeezy makes available to us the order and customer information we need to deliver and support your purchase, such as your name, email address, country or billing location, the product you bought, the amount paid and the order number. When an order is placed, Lemon Squeezy notifies our website, which checks with Kit whether the email address used for the purchase already belongs to a newsletter subscriber. If it does, our website marks that subscriber as a customer in Kit, so that our emails do not offer them a product they already own, and adds the first name from the order if Kit does not have one yet. If it does not, nothing about the purchase is stored in Kit and you are not added to the newsletter. Shayan SFE B.V. does not receive or store your full card details.
11. Hosting
Our website is hosted by Hostinger, which also delivers it through its content delivery network, provides our email mailboxes and supplies some technical components of the site. Whenever your browser connects to the website, hosting necessarily involves processing technical information, such as your IP address, connection details, the pages and files requested, and security logs. Emails you send to our addresses, and messages sent through our contact form, are stored in our Hostinger mailboxes. Hostinger processes this information on our behalf.
12. Records kept by our website
Our website keeps its own short records of free-resource signups, downloads and purchase notifications from Lemon Squeezy, containing the email address concerned, the IP address where relevant, the date and time, and the outcome. We use them to deliver what you asked for, to stop abuse such as repeated automated signups and to investigate errors, and they are deleted automatically after 12 months. They are stored on our hosting, outside the public part of the website. To limit abuse and to make sure the same order is never processed twice, the website also keeps short-lived technical markers in scrambled (hashed) form: counters linked to IP addresses, deleted within two days, and order markers, deleted after 180 days.
13. Other service providers
We may also use other carefully selected providers where they are needed for hosting, email delivery, checkout, payment processing, analytics, security, customer support or other website functions, and we give them personal data only as far as reasonably necessary for that function. Kit, Lemon Squeezy and Hostinger are our main providers today, but they are not necessarily the only parties that may receive personal data. For example, if your browser cannot display emoji by itself, WordPress, the software the website runs on, may load emoji images from WordPress.org, which then receives your IP address.
14. YouTube and external platforms
Our videos are published on YouTube. The website does not embed YouTube players: it shows preview images stored on our own server and links to the videos, so YouTube receives no information about your visit to our website until you follow a link to YouTube, from which point YouTube’s own privacy rules apply. The same is true of other external sites we link to, such as the Lemon Squeezy checkout. If we ever embed videos or other third-party content directly, that content may connect to the third party as soon as the page loads, and we will update this policy before we do so.
15. Cookies and similar technologies
When we checked the website on the date shown at the top of this page, it set no cookies for visitors and used no analytics, advertising or tracking cookies or similar technologies. The only thing it stores in your browser is a small note, kept by WordPress in session storage, about whether your browser can display emoji; it contains no personal data and disappears when you close the tab. We may use strictly necessary technologies to operate, secure or deliver the website, but we will not activate non-essential analytics, advertising, tracking or similar technologies before obtaining any legally required consent. Because nothing on the website currently needs that consent, there is no cookie banner; if that changes, we will add a consent tool and update this policy.
16. Tracking pixels
The website itself does not use tracking pixels. The emails Kit sends for us do contain one, as explained in section 9, and we apply the same privacy rules to tracking in emails as to tracking on web pages.
17. International data transfers
Some of our providers, such as Kit, Lemon Squeezy and Google, which operates YouTube, may process personal data outside the European Economic Area, including in the United States. Where the law requires it, such transfers rely on a legally recognised mechanism, such as an adequacy decision, the provider’s participation in the EU-U.S. Data Privacy Framework, the European Commission’s Standard Contractual Clauses or another lawful safeguard, and the mechanism can differ from one provider to another. 18. Retention
We keep personal data only as long as we need it for the purposes in this policy. Newsletter subscriber information is kept while you remain subscribed. After you unsubscribe, we no longer use your address for marketing, and Kit keeps your record marked as unsubscribed so that your choice is respected and you are not added again by mistake; you can ask us to delete that record entirely. Purchase, invoice and accounting records we hold are kept for the period required by Dutch tax and administration law, which is generally seven years. Support and refund correspondence is kept only as long as reasonably necessary for customer service, disputes, legal claims and record-keeping duties. Our website’s own request records are deleted automatically after 12 months, and technical and security logs held by Hostinger follow Hostinger’s hosting and security configuration. We do not keep personal data indefinitely just because it might be useful.
19. Data security
Shayan SFE B.V. takes appropriate technical and organisational measures intended to protect personal data against unauthorised access, loss, misuse or disclosure, taking into account the nature of the processing and reasonable security requirements. These include encrypted connections to the website, restricted access to our accounts and systems, signature checks on purchase notifications, download links that expire, and keeping configuration secrets outside the public part of the website. No system is completely secure, so we cannot promise that a breach will never happen, but if one does, we will handle it as the law requires.
20. Your privacy rights
Depending on the circumstances, the GDPR gives you the right to access the personal data we hold about you, to have it corrected, to have it erased, to restrict how we use it, to object to processing based on our legitimate interests, to receive data you gave us in a portable format where that right applies, and to withdraw your consent at any time. You can object to direct marketing at any time, and we will then stop using your data for that purpose. These rights are subject to legal conditions, and some data may have to be kept because of a legal obligation or for the establishment, exercise or defence of legal claims.
21. How to exercise your rights
Send your request to support@masteryourpresencenow.com. We will normally respond within one month, as the GDPR requires; for particularly complex or numerous requests this period can lawfully be extended, in which case we will tell you within the first month. Where necessary to avoid disclosing personal data to the wrong person, we may ask for reasonable information to verify your identity.
22. Complaints
If you are unhappy with how we handle your personal data, you can complain to us directly at support@masteryourpresencenow.com. You also have the right to lodge a complaint with the Dutch data protection authority, the Autoriteit Persoonsgegevens, or with another competent supervisory authority, for example in the country where you live or work, and you do not have to contact us first.
23. Required information
Joining the newsletter is voluntary, and giving your first name is always optional. Some contact, order or billing information is necessary to provide the services you request, complete a transaction, deliver a digital product or meet legal obligations, and if you do not provide information that a particular transaction or service needs, we or the merchant of record may be unable to provide it.
24. Automated decision-making
We do not make decisions based solely on automated processing that have legal or similarly significant effects on you. We do organise subscribers in ordinary ways: Kit tags record whether you joined through the newsletter form, requested a free resource or bought a product, emails can greet you by your first name, and we may use tags and engagement data to decide which emails to send to whom. This ordinary segmentation and personalisation does not have legal or similarly significant effects.
25. Sale of personal information
Shayan SFE B.V. does not sell personal information for money. We share personal data with service providers only as this policy describes, because they need it to provide their services to us or to you.
26. Children
Master Your Presence is directed at a general adult audience and is not intentionally designed to collect personal data from children. Where the law requires a parent’s or guardian’s authorisation before a child can give consent, for example to receive our newsletter, we respect that requirement. If you believe a child has given us personal data without the necessary authorisation, contact support@masteryourpresencenow.com and we will take appropriate steps.
27. Changes to this policy
We update this Privacy Policy when the website, our services, our providers, our processing practices or the law change, and the “Last updated” date at the top of this page shows the current version. An update never creates, after the fact, consent for processing that required your consent at the time the information was collected.
